 NOTE :  "Secret / Restricted" Aerial Photographs will, normally, be issued only to Govt. Official and those of local administrative bodies and educational institutions when required by them for  bonafide official work.  Indents should be sent to the OC No. 73 (APFPS) Party who will obtain prior clearance of Ministry of Defence for supply of aerial photographs of classification higher than restricted.

            b)         All Officers of the rank of Under Secretary to the Government of India and above in case of non-service department.

Note:   The above list is only an indication of the minimum level of the officers who are entitled to countersign the indent form.  An officer senior to his officer may also countersign the indent form.  Under Secretary/D(GS-III), Ministry of Defence may be consulted in case of any clarification is necessary.

 

2.         Powers are delegated to State Governments, concerned Ministries and Departments of the Central Government to authorize the issue of Secret / Restricted aerial photographs to Educational and Scientific Institutions and to other semi-Government Organisations for bonafide purpose (to be clearly indicated) subject to the conditions laid down in the Ministry of Defence letter No. 18(168)/84/D(GS-III) dated 31.1.1989.  The term semi-Government Organisations would cover those on which the Ministry/Department concerned of the Central Government/State Government has some control.  The indents in such cases will be countersigned by an officer of the rank of Deputy Secretary to the Government of India or above or the Secretary to the State Government.

3.         Clearance of the Ministry of Defence is essential for the issue of Secret/Restricted aerial photographs to private individuals, Organisations and commercial firms.  Indents for these, accompanied by the following particulars (in duplicate) should be countersigned by an officer of the rank of Joint Secretary or above in the State Government before they are referred to Ministry of Defence for obtaining clearance.

  4.         Demands from Foreign Embassies/Consulates in India for "Secret/Restricted" aerial photographs should be referred to the Ministry of External Affairs, Government of India.

 Note:   i)          All demands for supply of "Secret/Restricted" aerial photographs should be accompanied by a certificate in the form given on pages 4 & 6.

ii)                   The procedure for the safe custody etc. and for investigation of any loss of aerial photographs given in Ministry of Defence letter No. 18(168)/84/D(GS-III) dated 31.1.1989 should be followed.

iii)                 The annual certificate of safe custody of "Secret/Restricted" aerial photographs should be furnished in the month of January by the indentor on the prescribed form.

 Note:   This certificate should be duly completed in all respect and signed by the indenting Officer over his office stamp, as the responsibility for these aerial photographs lies with him.

CERTIFICATE 'A"

            I, ________________________________ (Name) agree that the sale to me by ____________________________ of the under mentioned "Secret/Restricted" aerial photographs is subject to following conditions which I hereby undertake to observe.

I.                    The aerial photographs will be treated as classified documents and I will take every reasonable precaution to prevent their being lost or being seen by or afforded access in any manner, to unauthorized persons.

II.                 I understand that the "Secret/Restricted" aerial photographs have been entrusted in confidence to me by a person holding office under Government in the event of my failure to take reasonable care of, or so conducting myself as to endanger the safety of the aerial photographs shall be guilty of an offence under Section 5(1)(d) of the Official Secret Act, 1923.  I have carefully read and understood the other provisions of the Official Secret Act, 1923 and fully understand the duty imposed upon me by the Act in respect of the custody, use and communication of the information contained in the said aerial photograph entrusted in confidence to me.  I have also understood that I would expose myself to criminal liability not only in the case of an intentional or willful act but also on arising out of my recklessness or ordinary negligence.

III.               No aerial photograph will be reproduced in part, or in whole, either by photography or by any other means except when it is necessary to do so for official purposes and the requisite permission in accordance with the Copyright Act has been obtained from the Surveyor General of India.

IV.              I will maintain a proper record of all the Secret/Restricted aerial photographs issued to me and undertake to periodically check these physically, I will furnish an annual certificate to the Survey of India (No. 73 Party, New Delhi)/Chief Secretary to the Government of _______________ (Name of State/Union Territory) in the month of January every year to the effect that all Secret/Restricted aerial photographs issued to me have been physically accounted for and losses if any, reported in accordance with the instruction in item (VI) below.

V.                 I require the aerial photographs for about _____________________ month/years/permanently from the date of issue and will return the same when done with to the issuing office.  If, however, called upon to do so in the meantime I will return the aerial photographs to the Director of Military Intelligence or their representatives.  I also/undertake to return to the Survey of India for destruction, the aerial photographs which become unserviceable due to wear and tear or otherwise.  I will claim no refund of the price of the aerial photographs on returning it/them.

VI.              I will immediately report the loss to the Ministry of Defence, New Delhi and also to the Head of the Department/Ministry* _____________________ (Name)/Chief Secretary to the Government of ** ________________________ (Name of State)/Union Territory/nearest Police Station to the Government of*** ___________________  and the Chief Secretary to the Govt. of  _________________ _________________  (Name of State/Union Territory) and the Survey of India for investigation and report to the Ministry of Defence.  I have understood that the loss of the Secret/Restricted aerial photographs may amount to  an offence under the Official Secret Act and that I am legally bound to give information about the offence immediately upon receiving knowledge about the loss of the said aerial photographs.  I have also understood that failure to report about the loss would render me liable for prosecution under Section 202 of the Indian Penal Code.  Handing over an aerial photograph to a subordinate officer does not absolve the indenting officer of his responsibility.

VII.            I also undertake not to export aerial photographs or any material produced there from abroad without the prior approval of the Ministry of Defence.

(To be completed by Educational/Scientific Institutions and other semi-Government Organisation in addition)

I.                    The aerial photographs are required for (state purpose) ___________________ ____________________________________.

II.                 The aerial photographs will be treated as classified documents and will take every precaution to prevent their being lost.

III.               The aerial photographs will be kept by a responsible officer designated by the Head of the Institution or Organisation concerned in safe custody and physically checked from time to time.

This office will also ensure that the aerial photographs are not seen or handled by unauthorized persons.

IV.              Aerial photographs when required by excursion parties, are given to in charge/leader (normally to be an Indian National and an Officer of the Institute /University/College/School/Organisation) who will be responsible for the correct handling of the aerial photographs and for handing them back to the Institute/University/College/School/Organisation, when no longer required for the purpose.

V.                 The authorities of the Institute/University/College/School/Organisation will be responsible at all times for the safety of the aerial photographs and to ensure that the rules made are being duly observed.

Note:   The Survey of India, No. 73 (APFPS) Party, New Delhi is responsible for obtaining the annual certificate of safe custody and for recall and destruction of Secret/Restricted aerial photographs after use, for all issues authorized by the Central Government.
